APPLICATION REFERRALS

To ensure access to everyone so that they can benefit from utilizing ADR ACCESS platform to resolve their disputes cheaply and quickly, individuals and entities, will be able to register their profiles FREE OF CHARGE.

After initial discussions with the Registrar and once their profiles are registered all users, individuals and entities will be able to log into their profiles to register said Application referrals. The platform will allow the user (APPLICANT) to register the Application referral without any upfront payment.

Once the RESPONDENT has confirmed (a) that the information supplied and documentation is correct and (b) uploaded their Heads of Argument, if so warranted, the APPLICANT will be invoiced the prescribed fee as set out in the Application Fee Schedule, for the hearing of the Application by an Arbitrator.

The Applicant will solely unless otherwise agreed to between the Parties will carry the costs relating to the arbitration process. These fees will include (a) the admin fee due and owing for the usage of the platform and (b) the costs relating to the appointed Arbitrator.

Upon receipt of the prescribed fee the Registrar will proceed to appoint and allocate a sole Arbitrator to hear the matter, in terms of the ADR ACCESS rules relating to the specific nature of the dispute.

The prescribed Application referral fee schedule has been classified by the Court in which the Application was lodged and on how urgent the Parties wish to have the matter heard.

Opposed Applications will be enrolled for hearing within 14 (fourteen) workings days from being filed and registered, while urgent opposed Applications will be enrolled for hearing within 3 (three) working days. Un-opposed Applications will be enrolled within 7 (seven) working days. All indicated fees are ex Vat (still to be added).
