Upon receipt of the NOTICE OF DISPUTE AND STATEMENT OF CASE the RESPONDENT will be granted 3 (three) working days to either table an offer of settlement or defend the allegations filed against him.
To lodge his response, the RESPONDENT will follow the directions provided in the email and/or SMS received to log into his own profile.
Once logged in the RESPONDENT shall be diverted to an information template where they will be requested to confirm and/or amend the information initially provided by the APPLICANT. Once finalized the RESPONDENT will then be positioned to either settle or defend the dispute.
Once the RESPONDENT has finalized his own profile the APPLICANT will be invoiced an once-off administration fee for usage of the platform. This fee or portion thereof, can be reclaimed by the APPLICANT at a later stage, during the course of the arbitration process to follow.
Once the RESPONDENT files his response (settle or defend the allegations) the ADR ACCESS platform will send a STATEMENT OF RESPONSE notification via SMS and email to the APPLICANT.
The Registrar will then appoint an Arbitrator to proceed with either the CON-ARB or PRE-ARB meeting.
