To ensure access to everyone so that they can benefit from utilizing ADR ACCESS platform to resolve their disputes cheaply and quickly, individuals and entities, will be in a position to register their profiles FREE OF CHARGE.

Once their profile is registered all users, individuals and entities, will then be able to log into their profiles to register a dispute when the need arises.

When registering a COMMERCIAL DISPUTE, the APPLICANT and RESPONDENT will each be liable to pay an once-off administration fee to utilize the platform. Individuals will be liable to pay R250 (Two Hundred and Fifty Rand) and entities R500 (Five Hundred Rand) irrespective if they are the APPLICANT or RESPONDENT.

When registering a LABOUR DISPUTE, the EMPLOYER, whether as APPLICANT or RESPONDENT, will be liable to pay an once-off administration fee of R750 (Seven Hundred and Fifty Rand).

If the RESPONDENT, after receiving the NOTICE OF DISPUTE AND STATEMENT OF CASE, decides to table an offer to settle the dispute and the APPLICANT accepts said offer the Registrar shall appoint an Arbitrator to finalize and issue an Award encompassing the terms and conditions of the settlement agreed upon. The costs pertaining to said appointment and Award shall be for the account of the RESPONDENT. An once-off fee of R2000 (Two Thousand Rand) shall be charged.

Once the Parties have filed their pleadings in a COMMERCIAL DISPUTE the Register has the discretion to initiate Pre-Arbitration proceedings in an attempt to save time and costs when it comes to the hearing of the matter. If initiated both Parties will equally be held liable for the costs pertaining to the Pre-Arbitration proceedings. An once-off fee of R1000 (One Thousand Rand) per Party shall be charged.

Once the Parties have filed their pleadings in a LABOUR DISPUTE the Register must initiate CON-ARB proceedings in an attempt conciliate the matter and if not possible to save time and costs when it comes to the hearing of the matter. The Employer will be held liable for the costs pertaining to the CON-ARB proceedings. An once-off fee of R2 000 (Two Thousand Rand) shall be charged.

If the dispute is not settled during the PRE-ARBITRATION or CON-ARB proceedings the Registrar shall then allocate an Arbitrator to hear the matter. Once allocated the Register shall approach the Arbitrator to provide a quotation. The Arbitrator shall submit his quotation to the Registrar and once agreed upon, all fees payable by the Parties shall be paid into an account allocated by the Registrar who shall disburse the funds as agreed to.

In COMMERCIAL DISPUTES both Parties are equally liable for the costs of the Arbitrator. In LABOUR DISPUTES the Employer is liable.

The filing of frivolous, unjustified, baseless, malicious and/or vexatious disputes must be avoided at all costs as the responsible Party could run the risk of being ordered to pay costs on a punitive scale by the Arbitrator.
