Registering a new dispute

STEP 1 - REFERRAL AGREEMENT

It is imperative to note from the outset that the ADR ACCESS platform can only be utilized to resolve disputes by Parties who agree in writing that the dispute can be referred for ARBITRATION to the platform.

If an agreement does not contain an ADR ACCESS dispute referral clause, the Parties can still after the fact refer a specific dispute to the platform by completing a separate agreement in which both Parties agree that said dispute be referred for arbitration to the Platform. Parties can by clicking on the RESOURCES navigation button found on the Home Page of our website (www.adraccess.co.za) download an ARBITRATION AGREEMENT that can be completed and signed by both Parties.

Only once all the Parties have agreed to the terms of the agreement and signed it, will they be positioned to refer the matter for ARBITRATION to the ADR ACCESS platform.
